Terms of Service for The Developer Host
These Terms of Service (“Terms”) govern your access to and use of the hosting services provided under the brand
The Developer Host (“we”, “us”, “our”).
By purchasing or using our services, you agree to these Terms.
Service Ownership Notice: The Developer Host is a hosting service operated as a service of
Digital Store, a business with a valid Trade License in Bangladesh.
Where these Terms refer to “The Developer Host”, it includes Digital Store as the service operator.
1. About Our Hosting Services
The Developer Host provides shared hosting, related support, and optional add-ons. Our services run on servers sourced from
third-party infrastructure providers (including Joypurhost). We may communicate with the provider to troubleshoot server-side issues.
However, the availability and performance of the underlying infrastructure may depend on the provider’s systems and maintenance.
2. Plan Information & Promotions
From 27/12/2025, new customers may be eligible to receive a plan configuration of
4GB RAM hosting as described on our website or invoice at the time of purchase.
Promotions, plan limits, and configurations may change without notice and may be limited by availability and fair-use policies.
3. Service Availability (No Uptime Guarantee)
We aim to provide reliable service, but we do not guarantee uninterrupted or error-free operation.
Service may be temporarily unavailable due to maintenance, upgrades, network issues, provider outages, security incidents,
force majeure events, or circumstances beyond our control.
4. Ordering, Account Information & Payment
- You agree to provide accurate and complete information when placing an order and maintaining your account.
- Payments are processed via our available payment methods/gateways. You authorize us to charge applicable fees for your purchase.
- We may decline or suspend an order if fraud, misuse, or policy violations are suspected.
5. Renewal, Expiry & Customer Responsibility
Your hosting service is provided for the purchased term and will expire if not renewed.
You are responsible for tracking your renewal date and ensuring timely payment to avoid interruption and data loss.
5.1 Renewal Notifications (Not Guaranteed)
We may send renewal reminders by email as a courtesy. However, renewal reminders are not guaranteed.
Email delivery can fail due to spam filters, customer mailbox limitations, incorrect contact details, or email server issues.
We are not responsible if you do not receive reminder emails or if delivery is delayed.
5.2 Price Changes
Hosting and domain renewal prices may change. If a change applies to your renewal, we may update pricing on our website or invoice.
Your renewal will be billed at the price applicable on the renewal date.
6. Suspension, Expired Accounts & Data Deletion
If your hosting is not renewed by the expiry date, your service may be suspended and your website may stop working.
After suspension/expiry, we may retain your data for a limited period (if any) for operational reasons, but:
- Your website files, databases, emails, and backups may be permanently deleted after the expiry period.
- Once deleted, data recovery is not guaranteed and may be impossible.
- You are responsible for keeping your own backups at all times.
Note: The exact retention window (if any) may vary based on server capacity, provider policy, and operational requirements.
We may delete data immediately or at any time after expiry if needed for compliance, security, or operational reasons.
7. User Responsibilities & Acceptable Use
- You must keep your login credentials confidential and notify us immediately of unauthorized access.
- You must not use the service for unlawful, abusive, harmful, or malicious activities (e.g., malware, phishing, spam, hacking).
- You are responsible for your content, website code, and compliance with applicable laws and third-party rights.
8. Support
We try to provide timely support. Support response time may vary due to workload, holidays, provider issues, or severity of the problem.
Provider-level issues may require coordination with the infrastructure provider and can take additional time.
9. Termination of Service
We may suspend or terminate your service without liability if you violate these Terms, engage in unlawful activity,
or cause risk/harm to our systems, other customers, or providers. Termination may result in the loss of data.
10. Disclaimer of Warranties
Services are provided “as is” and “as available”, without warranties of any kind (express or implied),
including merchantability, fitness for a particular purpose, or non-infringement.
Your use of the service is at your own risk.
11. Limitation of Liability
To the maximum extent permitted by law, The Developer Host and Digital Store (including their owners, affiliates, partners, and employees)
will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including loss of profits,
revenue, data, goodwill, or business interruption, arising from or related to your use of the service.
12. Refund Policy
All purchases are final. We do not offer refunds for hosting services once purchased or activated.
Please review your plan carefully before purchasing. If you have questions, contact us prior to payment.
13. Changes to These Terms
We may update these Terms at any time. Changes become effective upon posting on our website.
Continued use of the service after updates means you accept the revised Terms.
14. Governing Law
These Terms are governed by the laws of Bangladesh. Any disputes will be subject to the exclusive jurisdiction of the courts in Bangladesh.
